This Privacy Policy describes how Buildenza Infra Solutions Pvt Ltd ("Buildenza," "we," "us," "our") collects, uses, and shares your personal information when you visit or shop on our website, order via WhatsApp or phone, or otherwise interact with us (collectively, the "Services"). Buildenza's Services are powered by Shopify. "You" means anyone using the Services, whether as a customer, website visitor, or otherwise. Under the Digital Personal Data Protection Act, 2023 ("DPDP Act"), Buildenza is a Data Fiduciary — the entity that decides why and how your data is used — and you are a Data Principal, the person the data is about. If there's a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls on matters relating to your personal information. By using the Services, you agree to this Privacy Policy. If you don't agree, please don't use the Services.

CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy from time to time to reflect changes in our practices or in applicable law. We'll post the revised version here and update the "Last updated" date. Continuing to use our Services after a change means you accept the update.

WHAT PERSONAL INFORMATION WE COLLECT

Information you give us directly, which may include:

  • Basic contact details — your name, phone number, email address, and delivery/billing address.
  • Order information — the items you order, payment confirmation (not full card details — see Data Security), order value, and delivery instructions.
  • Account information — if you create an account, your username and password.
  • Shopping and browsing information — items you view, add to your cart, or save for later.
  • Customer support information — anything you tell us when you contact us via WhatsApp, phone, or the Site, including complaints, questions, or return requests.
  • Chatbot conversations — if you use the AI chatbot on our Site, the messages you send it and any details you share during that conversation.

Information we collect automatically, through cookies, pixels, and similar technologies: device and browser type, your IP address, pages visited, and how you navigate the Site ("Usage Data").

Information we receive from third parties: Shopify and our payment processor collect and share certain technical and transaction information needed to run the Site and process your payment.

Some features require this information — for instance, we can't deliver an order without your address. Where a feature isn't essential, providing the information is optional, but skipping it may limit what you can do on the Site.

HOW WE USE YOUR PERSONAL INFORMATION

  • To provide our Services — processing your order, arranging delivery through our logistics partners, sending order and delivery status updates, managing your account, and handling returns or exchanges.
  • To communicate with you — responding to customer support queries, including through our AI chatbot, and sending WhatsApp or SMS updates about your order.
  • For marketing, where you've consented — letting you know about new products, restocks, or offers relevant to you.
  • For security and fraud prevention — detecting suspicious orders or account activity, and protecting the Services from misuse.
  • To meet our legal obligations — including tax, GST, and consumer protection record-keeping requirements.

OUR LEGAL BASIS FOR PROCESSING YOUR DATA
Under the DPDP Act, our main basis for processing your personal data is your consent — free, specific, informed, and given through a clear affirmative action. You can withdraw consent at any time, as easily as you gave it, by contacting us — though this may limit our ability to provide certain Services. In a small number of situations, the law allows us to process your data without asking for separate consent — mainly where you've voluntarily given us information for a clearly specified purpose, or where processing is necessary to comply with a legal obligation.

COOKIES
We use cookies, pixels, and similar technologies: essential cookies that let the Site and checkout function, analytics cookies that help us understand how the Site is used, and — if we run digital ads — marketing cookies from platforms like Meta or Google. Since our Site runs on Shopify, some cookies are set directly by Shopify's own systems; see https://www.shopify.com/legal/cookies for details. Most browsers let you block or delete cookies through your settings; blocking essential cookies may prevent you from completing a purchase.

AI CHATBOT ON OUR SITE
We use an AI-powered chatbot on our Site to help answer product questions and assist with your order. When you chat with it, we collect the messages you send and any details you choose to share during the conversation. This information is used to respond to you and to improve the chatbot's accuracy over time. It may also be used by our chatbot's technology provider to train and improve their underlying AI models, in accordance with that provider's own privacy policy and terms — please don't share sensitive information (like full payment details or passwords) directly with the chatbot; use WhatsApp or phone for anything sensitive instead. You can request deletion of your chat history by contacting us at help@buildenza.in.

HOW WE DISCLOSE YOUR PERSONAL INFORMATION
We only share your personal information where it's necessary to run our business or required by law, including with:

  • Delivery partners (Porter, Shadowfax, or similar aggregators) — we share your name, phone number, and delivery address solely so they can complete delivery of your order.
  • Shopify, our e-commerce platform, which stores and processes your order and account data on our behalf.
  • Payment processors, who handle your payment directly — we never see or store your full card or bank details.
  • WhatsApp Business (Meta), which we use to send order confirmations, dispatch updates, and delivery tracking links.
  • Our AI chatbot provider, if you use the chatbot on our Site — see AI Chatbot on Our Site above.
  • Loox or similar review platforms, only if you choose to submit a product review.
  • Government or regulatory authorities, where required by law.
  • A successor entity, only if Buildenza is ever acquired, merged, or restructured.

We do not sell your personal information to third parties for their own independent marketing purposes.

OUR RELATIONSHIP WITH SHOPIFY
Our Services are hosted by Shopify, which also processes some of your personal information in its own right — not just on our behalf — in order to run and improve the wider Shopify platform. For example, Shopify may use data about your interactions with our Store, together with your interactions across other Shopify-powered stores, to power features like personalized advertising (Shopify Audiences). For that specific processing, Shopify — not Buildenza — is responsible for handling any requests you make about your data, since Buildenza doesn't control how Shopify uses that combined, cross-merchant data. DATA RETENTION
We keep different categories of your data for different lengths of time:

  • Order and tax-related records are retained for at least 72 months (6 years) from the due date of the relevant annual return, as required under Section 36 of the CGST Act, 2017.
  • Account information is retained for as long as your account is active, and deleted or anonymised within a reasonable period after you request account closure.
  • Customer support and chatbot conversations are retained long enough to resolve your query and for a reasonable period afterward.
  • Marketing consent and preferences are retained until you withdraw consent or unsubscribe.

DATA SECURITY
We take reasonable technical and organisational steps to protect your personal information, including restricting access to order and customer data and relying on Shopify's and our payment gateway's own security infrastructure. Your payment details are processed directly by our payment gateway and are never stored on our servers. No method of transmission or storage is completely secure — please avoid sending sensitive information over unsecured channels.

CHILDREN'S DATA
Our Services are intended for individuals aged 18 and above, and we do not knowingly collect personal information from anyone under 18. If you believe we've inadvertently collected a child's data, please contact us so we can delete it. We do not use children's data for tracking, behavioural profiling, or targeted advertising.

USER-GENERATED CONTENT
Our Services may let you post product reviews or other content visible to other visitors. Anything you choose to post publicly — including your name or display name — may be seen and used by anyone who visits the Site. We don't control who accesses this public content, and we're not responsible for how others use it once it's public, or for its accuracy.

YOUR RIGHTS AS A DATA PRINCIPAL
Under the DPDP Act, you have the right to:

  • Access — a summary of what personal data we hold about you and how it's used.
  • Correction — ask us to fix inaccurate or incomplete data.
  • Erasure — ask us to delete data we no longer need, unless we're legally required to retain it.
  • Nominate — nominate someone to exercise these rights on your behalf if you pass away or become incapacitated.
  • Grievance Redressal — raise a complaint and receive a response within a reasonable time.
  • Withdraw Consent — at any time, as easily as you gave it.

HOW TO EXERCISE YOUR RIGHTS
Email help@buildenza.in with your request and the phone number or email associated with your orders. We may ask you to verify your identity first. We aim to respond within a reasonable time and won't discriminate against you for exercising these rights. If we decline your request, you can ask us to reconsider — reply to our response and we'll review it again.

MANAGING COMMUNICATION PREFERENCES
We may send you promotional messages by email or WhatsApp. You can opt out at any time using the unsubscribe link in our emails or by messaging us on WhatsApp to stop promotional messages. Even after opting out, we may still send you non-promotional messages related to your account or an order you've placed.

Our Site may link to websites we don't control. We're not responsible for their privacy practices — review their own policies before sharing information.

CROSS-BORDER DATA PROCESSING
Some service providers (such as Shopify) may process data on servers outside India as part of their global infrastructure. The DPDP Act permits this except for transfers to specific countries the Central Government may restrict by notification — we don't transfer your data to any such restricted destination.
